CS2’s were appointed by the tenant, the UK’s leading bingo and casino chain, to defend a terminal schedule of dilapidations served by the landlord, originally in the order of £550,000. The tenant was held on full repairing and insuring terms for 25 years. Owing to a downturn in the commercial viability of a bingo hall in this location, the property was taken out of commission and boarded up for the final four years of the lease term, with little maintenance being undertaken during this time. The presence of asbestos, together with extensive vandalism during the final years of the lease, compounded the tenant’s liability giving rise to a detailed claim for damages issued by the landlord at lease expiry. CS2 was appointed by the tenant to defend the claim, taking into account current case law and local market conditions, whilst applying the limitations imposed by statute on the landlord’s claim for damages. The claim was settled at £100,000 in full and final settlement, saving the client £450,000, or 82% of the original claim.
